BROKEN BOW, Okla. — A former Arby’s manager in Oklahoma is facing felony charges after authorities say she intentionally spat into a customer’s food, while the customer alleges the incident left her infected with herpes.
According to court records and local reports, Amanda Hendricks, a former manager at an Arby’s restaurant in Broken Bow, was charged with felony poisoning with intent to injure after investigators reviewed surveillance footage that allegedly showed her contaminating food prepared for customer Jennica Church.
Church later filed a civil lawsuit claiming she tested positive for herpes following the incident and believes the infection was caused by consuming the contaminated food.
The lawsuit names Hendricks, Arby’s, and affiliated restaurant operators as defendants and seeks damages related to the alleged incident.
Investigators said surveillance footage obtained during the investigation appeared to show the former employee spitting into food before it was served.
Authorities subsequently launched a criminal investigation that resulted in felony charges and an arrest warrant.
The case has generated widespread attention due to the customer’s claim that she contracted herpes after eating the contaminated food.
Medical experts note that determining the exact source of a viral infection can be complex, and the allegation is expected to be a major point of contention in the ongoing legal proceedings.
Court records indicate that both the criminal case and civil lawsuit remain active. Prosecutors will be required to prove the criminal allegations beyond a reasonable doubt, while the civil case will address claims for damages stemming from the alleged contamination.
Neither the criminal charge nor the civil lawsuit has been resolved, and the allegations have not been proven in court.
Hendricks is presumed innocent unless and until proven guilty through the legal process.
