A former member of the New York Police Department has been sentenced to prison following a 2023 incident that resulted in the death of a fleeing suspect in the Bronx.
Erik Duran, a former NYPD sergeant, was sentenced to three to nine years in prison after being convicted of manslaughter in connection with the death of Eric Duprey.
The fatal encounter occurred during a police operation in the Bronx. According to prosecutors, Duprey was attempting to flee officers on a motorized scooter when Duran threw a hard-sided cooler filled with beverages in his direction.
The cooler struck Duprey, causing him to lose control of the scooter and crash into a tree. He suffered severe head injuries and was later pronounced dead.
During the trial, prosecutors argued that Duran’s actions were reckless and unjustified, emphasizing that throwing an object of that size and weight at a moving person posed a clear risk of serious harm or death.
The defense contended that Duran was attempting to stop Duprey and protect fellow officers during a rapidly evolving situation. However, the court ultimately rejected that argument.
The jury found Duran guilty of manslaughter, concluding that his conduct went beyond acceptable police tactics and directly led to Duprey’s death.
In handing down the sentence, the judge underscored the seriousness of the officer’s actions and the irreversible consequences for the victim’s family.
Legal experts note that the case is relatively rare, as on-duty police officers are infrequently sentenced to prison in connection with fatalities occurring during enforcement actions. The ruling is expected to contribute to ongoing national discussions about police use of force and accountability.
